I had a similar situation with a used gearcase one time.   The seller advertised a “good used gearcase in great condition, turns and shifts normally”.   When I received it, the driveshaft could only be turned using a pipe wrench on it and it would barely shift gears.   When I opened it up, the gears were all chipped and broken.  The seller gave me a hard time so I went direct to EBay, filed a complaint and got a full refund in less than 30 minutes.  eBay has always been good at resolving disputes like this.
